      AVO Against Parents Withdrawn

      Our client is an actuary who resides with his parents. The family had been having ongoing arguments which culminated in our client having a mental health episode.

      Our client’s parents called the police who attended and applied for an Apprehended Domestic Violence Order (ADVO). The matter was listed at Burwood Local Court.

      Our client approached our Burwood AVO Lawyers seeking our assistance in having the case withdrawn. We obtained a statement from our client as to his version of events and filed it with the court and on police.

      We then drafted representations for the withdrawal of the AVO. Central to this was that both of our client’s parents prepared statements with an independent lawyer addressing the relevant considerations under the Crimes (Domestic and Personal Violence) Act 2007 (NSW). We also highlighted that the incident stemmed from a mental health breakdown, our client was of good character, well-educated and relatively young.

      The matter was adjourned to allow the Prosecution time to consider our detailed representations. Within a matter of weeks, the prosecution agreed to withdraw the AVO.

      Our client and his parents were both overjoyed with the result.
