If the police issue you wth a penalty notice and you chose to pay the fine, you will not be required to attend court. The police may also issue you with an immediate licence suspension notice. If this occurs you will not be allowed to drive from the date of the notice. You will however have the option of appealing the licence suspension.
If you hold an unrestricted licence, you can generally only have your offence dealt with at court if you elect the fine to court without paying it. The only exception to this is camera-detected speeding infringements of over 30km/hr or 45km/hr.
If you are a provisional licence holder (ie. a p-plater), you can usually pay the fine and then elect the notice of suspension to court to appeal any suspension period the RMS have imposed.
Whether you lose your licence and the length of time of this suspension is a question for the court. An experienced licence suspension appeal lawyer will be able to provide specific advice and assess your prospects of success.
