      Bail Varied to Allow Client to Leave NSW Despite Prior Extradition 

      Recently Astor Legal appeared at Downing Centre Local Court in relation to an application to vary bail.

      Our client was charged with sexual assault after a tinder date. Prior to police arresting him, our client flew and had to be extradited back to Sydney. You can read about that successful bail application here.

      A few days later our client advised us that it was becoming too expensive to pay for the hotel he was residing at in Sydney.

      Further, he had job opportunities in Western Australia while he was unemployed in Sydney.

      We began preparing the application to vary bail conditions. We obtained a letter from the client’s sister who he would reside with. She was also prepared to act as surety and provide security of $10,000 to the court in support of the variation. 

      We also obtained evidence of 5 job offers he had received.

      When we appeared at Downing Centre Local Court and made the application to vary bail, we made lengthy submissions detailing how all bail concerns could be mitigated by the 13 proposed conditions.

      Despite the prosecution not agreeing with the application, the Court was persuaded to allow our client to leave the state and live with his sister while his case proceeds.
