Section 32 for Multiple Breach AVO Charges

Our senior lawyers appeared at Blacktown Local Court recently to defend an indigenous client.

Our client had three (3) charges of Contravene AVO dismissed today after we made a successful Section 32 Application.

The breaches related to over 100 messages being sent by our client to the Person In Need of Protection over a short period of time. This was a contravention of a no-contact condition on the AVO.

After commissioning a detailed report from one our preferred clinical psychologists, we prepared in-depth submissions citing the leading cases on the issue.

Despite the prosecution strongly opposing the application and our client having a prior criminal history, we were able to persuade the Magistrate to grant the application.

This means our client does not have any findings of guilt or criminal conviction for these charges
